These terms and conditions of sale define the contractual relationship:

a limited liability company with capital of CHF 20,000.00, with headquarters located at 125 rte de Vandoeuvres, CH-1253 in Vandoeuvres, listed on the commercial register of the Canton of Geneva under the number CH-660-1234010-2.
Hereinafter referred to as «We»;
On behalf of www.swiss-ecowater.ch, the online store of Swiss-Ecotechnologies Sarl,
Hereinafter referred to as the «Website»;
Of the one part;
AND
Any individual or company making a purchase on the Website for themselves or on behalf of a third party,
Hereinafter referred to as «You»;
Of the other part.
- ARTICLE 1. TERMS FOR PLACING AN ORDER
- 1-1 Any private individual placing an order on the Website declares to be aged at least 18 and to have the legal capacity or, failing this, parental consent allowing him/her to enter into the contract. In the event where these conditions are not respected in accordance with the clauses of this contract and in order to resolve any possible dispute, We reserve the right to contact directly the legal guardian of this person. We will therefore be authorised notably to demand from the legal guardian payment for all the orders that the person has placed.
1-2 Anyone placing an order for professional purposes on the Website declares to be aged at least 18 and to have the legal capacity or, failing this, the authorisation of the company, organisation, or any other related structure which may employ him/her, allowing him/her to enter into a contract on its behalf. In the event where these conditions are not respected, in accordance with the clauses set out in this contract and in order to resolve any possible dispute, We reserve the right to contact directly the person who has placed this order and to demand that he/she personally pays for the order, insofar as he/she will have previously assured Us when applying to open an account, that he/she was authorised to place an order on behalf of his/her company or on behalf of the company employing him/her at that time. - ARTICLE 2. STAGES TO THE CONCLUSION OF THE CONTRACT
- 2-1 The information featured on the Website does not constitute an offer in the legal sense of the term, in such a way that only the order which You place constitutes such an offer.
2-2 Any Internet user can consult the terms and conditions of sale on the Website. Consequently any order implies Your full and unreserved acceptance of the terms set out in this contract. Moreover, these terms are given to You during the confirmation process for each order, the registration of Your order being subject to Your acceptance of the terms. Anyone making a purchase on the Website therefore declares to have been aware of the terms and cannot deny this fact in the event of a dispute.- As the terms and conditions may be subject to modification, it is understood that it is the terms and conditions of sale in force when each order is placed which prevail.
- In the event of a dispute, an amicable solution will be sought and, failing this, any dispute, of any nature whatsoever, will always come under the exclusive jurisdiction of the courts of the territory in which Swiss-Ecotechnologies Sarl is domiciled and will therefore be subject to Swiss law.
- ARTICLE 3. RETENTION OF TITLE
- 3-1 The articles delivered to You remain Our property until such time as You have fulfilled your obligations to Us and notably paid the total amount of the invoice corresponding to the order which You placed on the website.
3-2 You remain liable for the loss or destruction of these items however as soon as they are delivered, even if You are not yet the owner because You have not yet paid for them.
3-3 In the event of late payment, in accordance with the payment deadlines clearly indicated on Your invoice enclosed with the ordered items when they are delivered, of non-payment despite reminders and in the event where no conciliation can be found, We reserve the right to demand that these items are expressly returned to Us at Your expense. - ARTICLE 4. PRICE POLICY
- 4-1 The prices displayed on the Website are expressed in Swiss francs [CHF], inclusive of all taxes applicable in Switzerland, but excluding postage and packaging costs. Calculated according to where Your order is to be delivered, these charges will be invoiced in addition to the amount of the items in Your order.
4-2 The price displayed on the Website at the time You place Your order is guaranteed, unless it has been modified (upwards or downwards) by the supplier between the previous order and Your order. - ARTICLE 5. AVAILABILITY AND DISPATCH LEAD TIMES
- 5-1 Each product information sheet featured on the Website gives the item’s availability and a time span in which it is likely to be dispatched. These details however are for information purposes only. Therefore, they cannot be guaranteed, as they are dependent on Our stock levels and on those of Our suppliers:
5-2 If Your order contains multiple items, You can choose Your preferred delivery option: a combined dispatch of all the items in Your order or a split item dispatch whereby the items available when you place your order are dispatched separately from the items available at a later date.
5-3 However, and despite all the precautionary measures which We take with Our suppliers to ensure We have the most accurate information possible regarding the availability of the items which We offer, it may arise that one or more of them, deemed to be available when You place Your order is in fact unavailable, a situation about which We will not fail to inform you:- If the item is temporarily unavailable, We will consider that your order is still valid until We are able to fulfil it. However, if the lead times for the supply of the items in Your order are not guaranteed by Our suppliers and it therefore seems impossible for Us to deliver them to You within a reasonable time, We reserve the right not to continue with the order and to ask You to place the order again at a later date.
- If an item in Your order is permanently unavailable [out of stock, no longer on the market, etc.], We will be obliged to cancel the order. We may then make a recommendation regarding an item of similar quality and price which You will be free to take up or decline.
- ARTICLE 6. DELIVERY TERMS
- 6-1 The ordered items are dispatched to the delivery address selected by the customer when the sale is made.
6-2 We will endeavour to deliver the goods within 30 days, unless otherwise stated when the order is placed.
6-3 We will inform You of any delay to the delivery but will not be held liable for the payment of any compensation in the event of a delay.
6-4 Delivery charges are given in the "My basket" section and are subject to Your approval when You confirm each order. - ARTICLE 7. PAYMENT METHODS
- 7-1 Advance payment
You pay by Online Banking, using a postal or bank account. You receive the payment information after placing the order. Once Our accounts department registers Your payment, the item is dispatched.
7-2 Collect on delivery
You pay the postman/postwoman directly on delivery. The post service charges a fee of CHF15.00 for packages under 20kg. Packages heavier than 20kg will be delivered on a pallet. In this case handling fees increase to CHF 30.00. This type of payment is possible for orders up to the sum of CHF 3000.00.
7-3 Invoice
Customers from companies and public institutions will receive the items delivered with an invoice after a credit check. For this you must make a request through your customer account, then this request must be approved by Swiss-Ecotechnologies Sarl. - ARTICLE 8. TERMS AND TIMEFRAME OF THE RIGHT OF WITHDRAWAL
- 8-1 in accordance with Swiss law, anyone placing an order on the Website has a period of 7 (calendar) days in which to exercise his/her right of withdrawal, as from the date of acceptance of the sales contract, i.e. the date of confirmation of Your basket and the confirmation by e-mail of the fact that We have received Your order and that We will proceed to process it.
8-2 in the event where Your request to withdraw does not meet the terms defined by this contract, We have the right to demand that You pay the full amount of the item(s) included in Your order. - ARTICLE 9. RETURNS AND EXCHANGE POLICY
- 9-1 In the event of defects in the goods unattributable to the customer or any item which does not comply with Your order, We will accept the return of the goods and proceed to exchange them.
9-2 The purchased product however must be returned immediately in its original packaging, unused and undamaged, to the following address:

9-3 The machines We sell come with a 24 month warranty. This warranty covers only all faulty parts.
9-4 This warranty does not apply to any damage caused by accident, abuse, improper use, flood, fire, earthquake, electrical problems, natural disasters and in particular lightning which may have damaged the equipment via the electricity network, problems affecting the water distribution system or other external causes; to any damage caused by the product being operated outside the permitted or intended uses described by: Swiss-EcoWater®; to any damage caused by service carried out by anyone who is not a Swiss-EcoWater® representative or a Swiss-EcoWater® service provider; to a product or part which has been modified in such a way as to alter functionality or capability without the written permission of Swiss-EcoWater®; or if any Swiss-EcoWater® batch number has been removed or rendered illegible. - ARTICLE 10. 10-2 License to access the Website
You are authorised to access and use the Website for personal use only and cannot under any circumstances, except with our express written consent and under penalty of prosecution, use it or any of its content for commercial purposes or for any other activity which may harm us.

All the clauses featured in these terms and conditions of sale, as well as all the purchasing and sales operations to which they apply, are subject to Swiss law.
10-4 Liability
We undertake to use all possible means to guarantee the best quality service possible in accordance with Our company's values. However, We cannot be held liable for any delay in the delivery of the ordered items and notably in the event of items being out of stock with our suppliers or for any delay in the delivery of these items by La Poste, Our order distribution partner, or its international partners.
Despite Our vigilance and all the precautions which We have taken with the partners with whom We work to enable You to make use of the services which We offer, We cannot guarantee that the operation of the Website and its various sections will not be interrupted. Consequently:
We disclaim all liability for any direct or indirect damage which may result from accessing or using the Website or part of it, in the same way that We disclaim all liability which may result from the inability to access or use the website.
10-5 Data protection- Whatever the nature of the personal information relating to You which We have obtained, either which We have rightfully asked You in the framework of this contract, or which We have collected through automated means, We undertake to use all necessary means to process it in the strictest confidence, to ensure it is protected and to use it only to fulfil Your requests or to improve the services which may be offered to You on the Website.
- You can however at any time exercise Your right to access, rectify or contest this information from Your customer account or by sending Us an e-mail.
The design, form, title and all the content of the Website are the strict property of Swiss-Ecotechnologies Sarl. Consequently:- Under no circumstances are you authorised to copy, record, reproduce or print this content for any use other than that which will enable You to make purchases on the Website in the framework of this contract.
- We and Our partners reserve the right to take action against You if any of this content, of any nature whatsoever (image, text, codes, etc.), which is owned by Swiss-Ecotechnologies Sarl or one of its partners, is used without Our express written consent or that of Our relevant partners, for purposes other than those stated in this contract.
- The publication on the Website of comments, communications and other content which You may send Us for this purpose, remains at our complete discretion.
- In the event of their publication, You automatically grant Us the right to use, reproduce, modify or delete this content if We deem it necessary, content to which moreover You are required to have the copyright.
